1. Acceptance of terms
By using Unstuck, you agree to these Terms of Use. If you do not agree, do not use Unstuck.
2. What Unstuck is
Unstuck is a self-guided wellness and reflection app that offers tools for reset, focus, reflection, journaling, check-ins, routines, affirmations, personal organization, and personal reminders.
3. Not medical advice
Unstuck does not provide medical advice, diagnosis, treatment, therapy, crisis support, medication guidance, clinical recommendations, risk assessment, or clinical monitoring.
4. Not therapy or psychiatric care
Unstuck is not a substitute for professional mental health care, psychiatry, therapy, primary care, medication management, or any licensed clinical service. Unstuck is not monitored by clinicians.
5. Not for emergencies
Unstuck is not designed for crisis or emergency situations. If you are in immediate danger, may harm yourself or someone else, or need urgent support, contact emergency services immediately. In the United States, call 911 for emergencies or call or text 988 for crisis support.
Messages, journals, reminders, check-ins, and other app activity are not monitored for safety or emergency response.
6. No provider-patient relationship
Use of Unstuck does not create a provider-patient, therapist-client, doctor-patient, or similar relationship with Unstuck, shrinkMD, Shariq Refai, MD, MBA, FAPA, or anyone associated with Unstuck or shrinkMD, even if Unstuck was created by or affiliated with licensed healthcare professionals.
7. Use at your own discretion
You are responsible for deciding whether the app's self-guided tools are appropriate for you. You assume responsibility for your use of the app. Stop any exercise if it feels uncomfortable, unsafe, distressing, or physically unpleasant.
8. No guarantee of outcomes
Unstuck does not guarantee any outcome, improvement, relief, emotional benefit, behavioral change, wellness result, reminder delivery, organizational result, or uninterrupted access.
9. Reminders are convenience features
Notifications and reminders may be delayed, blocked, or not delivered due to device settings, operating system behavior, permissions, battery optimization, Do Not Disturb settings, focus modes, connectivity, software updates, or other technical factors.
10. Pill reminders are backup reminders only
Pill reminders are personal organizational tools only. They do not provide medication advice, dosing guidance, refill authorization, adherence tracking, medication management, safety monitoring, or clinical monitoring.
Do not rely on Unstuck as your only method of remembering medication. Users remain solely responsible for medication use, timing, dosage, refill management, and following instructions from licensed healthcare professionals and pharmacists.
11. Appointment reminders are personal organization only
Appointment reminders are personal organizational tools only. They do not verify appointments, communicate with providers, coordinate care, or guarantee attendance. Unstuck does not perform appointment management, healthcare scheduling, care coordination, clinical follow-up, provider communication, or telehealth scheduling.
Notification delivery depends on device settings, operating system behavior, permissions, battery optimization, Do Not Disturb settings, focus modes, and other technical factors. Do not rely on Unstuck as your only reminder for important appointments. Users remain solely responsible for managing and attending their appointments.
12. Journal entries and check-ins
Journal entries and check-ins are personal awareness tools. They are not clinical records, diagnostic tools, screening tools, symptom measurements, psychological assessments, or mental health measurements.
Patterns or trends displayed by the app should not be interpreted as medical, psychiatric, psychological, or clinical analysis.
13. Local data and exports
Unstuck is designed to store app content locally on your device. You are responsible for backing up information you want to keep and for securing exported files. Once you export information from Unstuck, the exported file may be handled by the apps, services, devices, or people you choose to share it with. See also Section 20 (Eligibility) and the Privacy Policy Section 24 (COPPA) for age and children disclosures.
14. Intellectual property
All app design, text, branding, graphics, features, and content belong to Unstuck or its owners unless otherwise stated. You may not copy, reproduce, distribute, modify, or create derivative works from Unstuck content without permission, except as allowed by law.
15. Third-party platforms and services
App stores, operating systems, device services, hosting providers, and other third-party services may have their own terms, privacy policies, and technical requirements. Unstuck is not responsible for third-party services.
16. No warranty
Unstuck is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Unstuck disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
17. Limitation of liability
To the fullest extent permitted by applicable law, Unstuck, shrinkMD, Shariq Refai, MD, MBA, FAPA, and associated parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, device issues, interruption of access, reminder failures, exported file exposure, or decisions made based on use of the app.
18. Changes to these Terms
We may update these Terms from time to time. Continued use of Unstuck after updated Terms become effective constitutes acceptance of the updated Terms.

20. Eligibility
You must be at least 17 years old to use Unstuck. By using Unstuck, you confirm that you are at least 17 years old. If you are a parent or guardian and your minor child has used Unstuck without permission, please contact us at support@beunstuck.app.
21. User content
Anything you write in Unstuck (journal entries, check-ins, notes) stays on your device unless you choose to export it. If you choose to export and share any of it, you are responsible for how that file is handled and for the content itself.
You agree to use Unstuck only in ways that are legal and that do not infringe anyone else's rights. You agree to indemnify and hold Unstuck, shrinkMD Publishing LLC, shrinkMD, Shariq Refai, MD, MBA, FAPA, and anyone associated with Unstuck harmless from any claim, demand, liability, or expense (including reasonable attorneys' fees) arising out of content you create, export, or share through Unstuck, except to the extent the claim is caused by Unstuck's own conduct.
22. Governing law, venue, and dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules.
Binding individual arbitration. Any dispute, claim, or controversy between you and Unstuck arising out of or related to Unstuck or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Pinellas County, Florida unless you and Unstuck agree otherwise, or, at your election, by video or telephone.
Class action waiver. You and Unstuck each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding. Disputes will be resolved on an individual basis only.
Small-claims carve-out. Either party may bring an individual claim in a small-claims court of competent jurisdiction in place of arbitration.
Thirty-day opt out. You may opt out of arbitration by emailing support@beunstuck.app with "Arbitration Opt-Out" in the subject line within 30 days of first accepting these Terms. Include your name and the email address associated with any communications you have had with Unstuck.
Venue for non-arbitrable claims. The exclusive venue for any claim that is not subject to arbitration is the state or federal courts located in Pinellas County, Florida, and you and Unstuck each consent to personal jurisdiction in those courts.
23. Limitation period
To the extent permitted by law, any claim related to Unstuck must be filed within one year after the claim arose, or it is permanently barred.
24. Cap on liability
To the extent permitted by law, Unstuck's total cumulative liability for any and all claims related to Unstuck will not exceed one hundred United States dollars ($100) or the amount you paid for Unstuck in the 12 months before the claim, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limits may not apply to you.
25. Severability, integration, assignment, waiver, force majeure
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with the Privacy Policy, Consumer Health Data Notice, and any feature-specific terms displayed in-app, are the entire agreement between you and Unstuck about the use of Unstuck and replace any prior agreements on this subject.
You may not assign these Terms or any rights under them. Unstuck may assign these Terms in connection with a sale, merger, financing, or reorganization, on notice to you.
A failure to enforce a provision is not a waiver of that provision. A waiver in one instance is not a waiver in another.
Unstuck is not responsible for delays or failures caused by events outside its reasonable control, including hardware failures, internet outages, app store outages, third-party service outages, and acts of nature.
26. Survival
Sections 3-12, 14, 16, 17, 21, 22, 23, 24, and 25 survive termination of these Terms or your use of Unstuck.
27. United States only; international users
Unstuck is designed, operated, and marketed for users in the United States. The crisis resources, regulatory framing, age threshold, and dispute-resolution provisions in these Terms are all written for U.S. users. Unstuck has not been designed, classified, or registered as a regulated medical device in any jurisdiction, and is not intended to diagnose, treat, cure, prevent, or mitigate any disease or condition.
If you access Unstuck from outside the United States, you do so on your own initiative and you are responsible for compliance with your own local laws, including any local rules that classify wellness software as a regulated product. Unstuck is not currently offered in jurisdictions where its features, language, or content would require local licensing, registration, or translation that has not been completed. Local crisis services in your country always take precedence over the U.S. resources listed in the app and on the website; see Safety for an international helpline directory.
28. Not a medical device
Unstuck is a self-guided wellness and reflection app. It does not monitor, detect, predict, diagnose, screen for, alert anyone to, or measure any disease or condition. The app does not produce a clinical score, a risk score, or any output intended to drive a clinical decision. Anything the app displays is for your own personal reflection only.
